Legal Question in Landlord & Tenant Law in California

Trespassing?

My wife went out of town to visit her family and left a key with one of her friends without my knowledge. My name is on the lease and my wifes name is not. My wife called me a couple weeks later saying that she's not coming back had someone go into the apartment while I was at work and take things...some of them being mine. is this trespassing/burglary? What legal options do I have, being that this person did not have permission from the owner of the property or me the leasee/. They also still have my key. Thank you

Re: Trespassing?

Your wife may not be on the lease, but she had persmission to occupy the premises and thus implied permission to have someone enter the premises and retrieve her property. This is a civil matter between your and your wife, not trespassing or theft.
