Legal Question in Legal Ethics in California

Act of God?

I visited a friend at his apartment complex. When I left that evening a huge tree branch had fallen on my new car and scratched and dented it in on the drivers side. The tree is half dead and the roots are in the duplex behind the apartment building. The apartments say it is not their tree, and the management company for the duplex says it is an act of God. This tree is dead and needed to be trimmed 20 years ago, I say it is neglect, they say it is an act of God, who is right? I have a $500 dollar deductible on my insurance and that is about what it will cost to fix my car, I have 3 witnesses that heard the branch crack off and fall on my car, they are people that were coming and going that night in the parking lot. Please tell me what legal recourse I have at this point. Thank You...Lynette

you can try small claims court but be ready to prove neglect
