Legal Question in Legal Ethics in California

wedding caterer tip

I got married in July of 2007 and when I signed a contract with my caterer, she put a 18% tip into the amount quoted. I was fine with that at the time, but after the wedding and her horrible service and lack of quality, I don't feel she deserved a tip. I have filed a BBB complaint and asked for my tip back and she refused. Can I sue for my tip back even though I signed a contract saying I'd give her that amount? I feel that a tip should be given for quality service.

If the contract was not fulfilled, you should not have to pay.
