The irresponsible attorney

On Feb 24 2000 I had some cash taken from me, by the D.E.A., in the Sacramento Airport because it I didn't have a the proper documents to show where it (the money) came from. I filed all the nessesary paperwork to get my property back until I got down to the last phase which was a petition I had trouble understanding. I took the petition to an attorney who had 20 days to file it as stated in the petition. Not only did he not do so but he's not returning phone calls and I think he's changed offices. My question is that if I lose out on getting my money back from the D.E.A. because of his lack of working can I file suit against him (the faulty attorney) and how? Now we didn't sign anything but he's got my paperwork and I've got witnesses that'll confirm that he agreed to help me.

Yes, you can and should sue the attorney.
