I was placed in default due to errors by my attorney. Because I could not defend myself, I now have a finalized judgment against me. I plan to file a malpractice against my attorney. My question is concerning an appeal of the decision. What effect will filing an appeal have on my malpractice suit against my attorney for the following scenarios:

1- My current attorney files the appeal for me

2- My current attorney does nothing (does not appeal the judgment)

3- I hire a lawyer and he files an appeal of the judgment

Would any of these scenarios get my current lawyer off the hook concerning the malpractice case I plan to file against him?

Your current lawyer should be asked these questions. I hesitate to answer when other counsel is involved.

It is unclear, though, whether you have the same lawyer you want to file malpractice against.
