Legal Question in Medical Malpractice in California

Anesthesiologist gone bad...

During my c-section the medication wore off. When I expressed to the doctor that I could feel everything, he repeatedly thumped me in the forehead and told me it was all in my head and he wouldn't give me anything to take it away. I am in therapy for PTSD among other things due to this. Is this considered malpractice? It has given me some pretty serious psychological problems. (nightmares, hives, OCD, depression, etc.)

Yes. But, given the economics of medical malpractice today, I doubt any attorney would want to take the case since the damages do not seem to warrant a large enough award.

I wouldn't mind reviewing your records free of charge. Send ALL records, including mental, if interested.

Your statement of the facts suggest that you may in fact have a malpractice case if borne out by the records. You neglect to mention the date of the C-Section so I cannot determine if there is a Statute of Limitations issue with respect to your matter. Please feel free to contact me directly to have a preliminary discussion (no charge) regarding the case. (310)559-9445.
