Legal Question in Medical Malpractice in California

knee replacement

My doctor put the knee in wrong and has hurt since I got it 3 yrs ago. Should I file a complaint with the Medical board first or will that interfer if I file a lawsuit against the doctor?

Re: knee replacement

Nice try. The statute of limitations is one year from discovery of the problem, or three years max from procedure. Even if you are still within that, you must have a doctor as an expert prepared to testify that there was 'malpractice'. Without that, you can't even file. Your opinion and mine are irrelevant.

Why not go elsewhere and have it repaired?
