Medical Equipment Left Behind

Two weeks ago I had lower jaw surgery and during my post-op xray I noticed ''something'' left behind. It turns out is is probably the drill bit used to attach the plates and screws. The doctor has offered to remove it at a later date, only after they said it would be OK there forever and I inisted it would be removed. Do I have a case for malpractice? If so, do I have a right to compensation for pain and suffering?
