Legal Question in Personal Injury in California

i was in an accident on june 19th 2010. I was at fault. The other driver fled after noticing damage was mainly to my vehicle. I was unable to call police due to no phone with me at time. My insurance is currently investigating the claim. I have admitted fault to insurance adjuster. Several calls to investigator of claim have not been returned. He asked for my records for the month of June, a letter from property manager from where i reside and contact information of my parents where i went to after the accident. Unbeknownst to me i was without car insurance for a couple of weeks in the beginning of June but had reinstated my insurance on the 16th of June. What rights do i have to get my car repaired ASAP from my insurance company? Stressful situation this has been and the lack of communication with insurance (geico) is not helping.

Assuming that you actually had valid car insurance in effect on June 16th, and that this insurance included coverage for property damage to your vehicle, and that you have reported the accident to your company in compliance with the terms of its contract with you, then you have an absolute right to have your car repaired at once. Call your favorite body shop and ask them whether they are willing to work with GEICO, if not, find another shop that will work with GEICO. Get your car to the shop and let them deal with setting up the inspection and authorization for getting the work done. Check your policy to see whether you have coverage for a rental car, so that you can get around while your car is being repaired. As for what GEICO is doing in its investigation of the claim, I suspect there may be more to this matter than you have disclosed in your question, however, you should keep a record of your conversations and interactions with GEICO, you may want to have the California Insurance Commissioner look into what GEICO is doing in its investigation of this claim if you feel that GEICO is invading your privacy or is improperly denying coverage for this accident.
