Legal Question in Personal Injury in California

accident

My 3 year old daughter was a passenger in somone elses car that was hit from behind, what type of claim could I make? I was also involved in an accident that broke my back now I'm unable to work do I have a claim?

If your daughter was injured, she may have a claim. Since she is a minor, an adult must be appointed Guardian Ad Litem. Any settlement must then be approved by the court. There is a 1 year statute of limitation on any personal injury claim.

As for your claim, again you may have a good claim if your injuries were from the accident.

Hopefully Mr. Drescher was referring to your claim having a one year statue of limitations not your daughter who as a minor can file a claim until she turns 18.
