If the car going off the cliff was not your fault, the amount offered is not proper compensation for the two injuries you describe, let alone any other damages you may have sustained, such as wage loss, future earnings impairment, the risks associated with your injuries in the future and further injuries which may not manifest themselves for weeks or months.

There is no rush to settle, as you have two years in California to file a lawsuit for negligence and injuries arising from a car crash.

I would be happy to speak with you for free if you have further questions or would like advice.

I hope you recover quickly.

I think that it is what I would call a low ball offer! I use to work in claims and the insurance company always paid less if there was no attorney. Don't be a victim a second time! I advise you to seek legal counsel. Don't even call the claims representative to reject that offer; just ignore it. You were a passenger and not at fault here and additionally, while you may not have been severely injured your claim is certainly is worth more than that if you treated at all. I hope this helps.
