Legal Question in Personal Injury in California

City of Riverside's Tree falls on my car

I had my car legally parked on a public street. A huge limb from a City Owned tree on city property broke off the tree and smashed my car. The limb was so big it was on the opposite side of the street.

Who is responsible for the damage and if my insurance pays it who is liable for the deductible?

The city is responsible, and should pay your deductible.

Your insurance company should appoint an attorney on your behalf.

You need to complete and return a City claim form, certified mail RRR please, listing all the damages. Only after your claim is denied can you go to small claims (or other) court. Then the city would be liable.

Unless, of course, it was a ficus tree.
