faulty air baga

air bags did't deploy during auto accident. what recourse do i have? 1996 grand cherokee jeep.

They typically are set not to deploy at less than 25-35 mph frontal impact, not at all on side impact. If you can get an auto/accident expert to say they were defective, and you were injured worse than if they had deployed [facial and torso 2nd degree burns from the bag], you would have the basis of a case. Airbags are designed to deploy in certain types of accidents only. If the failure of the airbags to deploy contributed to the severity of the injuries to the drive and passenger, then you should consult an attorney to investigate whether you have a good case for personal injury on that basis.

You can sue the manufacturer under the theory of product liability. However, the mechanics of the accident are very important, (i.e., were the air bags supposed to deploy and they failed to do so?).

If the first prong is satisfied, then the most important question is what are the damages that could have been prevented had the air bags deployed?

Products liability litigation can easily cost the prosecuting attorney $50,000+ to put on a decent trial. Thus, if the damages are just a sprain and strain type of injuries, then forget it.
