Legal Question in Personal Injury in California

File a Federal Tort Complaint Against VA

I'm a law clerk and my boss has asked me to find out where a federal tort complaint against the Veteran's Administration should be filed. As in which office. It's a medical malpractice case and we are in Los Angeles.

Re: File a Federal Tort Complaint Against VA

If you are referring to the administrative claim for damages (Standard Form 95), it could be presented to the office of the director of the VA hospital where the alleged malpractice took place, or to the office of the Regional Counsel at the VA Regional Office in the LA area. You must make sure of delivery, and don't just drop it in the mailbox. If you send it by Certified Mail, also order a Return Receipt.
