Legal Question in Personal Injury in California

A guy hit my car. No damage to his pick up. He denies it ever happened and his insurance company backed him up.

His tire hit my door, so no damage to his pick-up. He denies it and the insurance company agreed with him since they couldn't find damage on his P/U, even though I have all his personal and insurance information.

Need to know if I should sue him or the insurance company in small claims

You can not name the insurance company as a party. Suing their insured brings them in but not as a party. You have a very difficult case to provide, especially if the other drive says he gave ;you the info because he stopped when you waived him down and gave his infor because you insisted.

Submit it to your insurance and let them go after him.
