Hit by car while in crosswalk

Several months ago I was hit by an SUV while in crosswalk crossing street. I was on way to neurosurgeon to consult about operation on my neck. I am disabled with cervical disk disease. I was thrown to pavement and rec'd a jolt, starting having incontinence but no other injuries as my exiting condition w/serious neurological symtoms is so bad. Neurosurgeon immediately put me in a collar and said "coughing the wrong way could make me a quadraplegic" I had surgery a month later. Two attys I've consulted say unless I can prove "harm" from this accident (only new symptom, incontinence wa cured with surgery), I've no case. SuggestionS?

If your condition was worsened as a result of the accident that is enough for you to present a claim for the increased problems.
