Legal Question in Personal Injury in California

I was hit by a suv while riding my motorcycle. We were stopped at a red light and when the light changed he went and rear ended me. Took the bike out from under me and I landed on the ground. The police came and took all the statements including one from a witness. I've been checked out at the hospital and nothing is broken but I'm still having back/neck pain and a headache I can't seem to get rid of.

So far I've had to pay my medical copays and may even need massage or chiro for my back/neck. Will his insurance be responsible to reimburse me for my expenses or do I need a lawyer to take care of it? It's rough as I'm not able to work and these little expenses are adding up quickly. The tow truck, copays, missed work, etc.

You most definitely have a solid claim against the SUV's driver and his insurance should take care of all your bills. If you are in pain, especially unresolved headache, you should have proper testing done to rule out potential problems that may have been undetected at the hospital.

I recommend my clients to go to their primary care physician for evaluation and referrals. If my clients have no health insurance or primary care physician, I usually recommend reputable doctors who treat them on lien (credit) basis.

I'll be happy to help you out with free advice and if you decide to get representation, these types of cases are done on a contingency basis. Meaning the lawyer gets paid when there is a recovery. Check my rating on www.avvo.com and if you like what you see, contact me.

Like the other attorneys, I have handled many, many motorcycle PI cases and yes the party's insurance is responsible. What I think can also offer is insight to the insurance company's claims dept.'s thinking on liability, value and negotiation strategy based on my nearly 15 years of claims experience and being a national claims training administrator responsible for claims adjusters' and claims managers' training besides my legal experience. Representation does not involve any out of pocket $ by you. It is all contingent on the recovery only. Feel free to contact me if you have any questions. Regards, Bob Worth. (818) 222-2433
