Legal Question in Personal Injury in California

injured in car from hard standing seatbelt

I was going somewhere with my friends in his car. I was in the backseat and the seatbelt holder was one of the freestanding hard ones and it slid up my tailbone causing me to be in bed for 10 days. Im in excrusiating pain and may have to cancel a trip to England. What are my rights and who should be held accountable?

Re: injured in car from hard standing seatbelt

You don't say whether you were in an accident or simple sat on the holder. If it was an accident, then the person who caused the accident is responsible. If you just sat on it, likely you are responsible. It would be a stretch to hold the auto manufacturer responsible for a design defect, especially when you chose to sit as you did.
