Legal Question in Personal Injury in California

What do i do now

I was involved in an accident on my motorcycle where a car turned left infront of me from the right hand lane. my injuries were minimal (only a sprained sholder) and my bike actualy was not badly dammaged (bent headlight bracket and a new leak developed from the shifter on the left side of the bike). At first the other guys insurance company was cool and they imediatly offered a rental car and to have someone look at the bike so they could repair it. My mechanic whom i trust said the repairs would be about 700.00 and after the adjuster finished the insurance agency offered 25.00 for me this is not about the money but about the principle of the thing, i think they should take responsability for their client and if they really want to put a price tag on it 25.00 is just like a slap in the face. Should i seek legal councel or just sit back and take the settlement now? my own insurance company wanted nothing to do with this, becouse i only have state minimum insurance and it was the other guys fault. confused and dazed

Your best bet would be to sue the other guy in small claims court. Be sure to have copies of all medical bills and estimate for the repair to your bike.

You can file a small claims lawsuit against the car's driver. No lawyer is needed. Bring photographs, diagrams, etc., and your written repair estimate. Then, when you get a judgment against the car's driver, try to collect it. The insurance company would then probably pay the judgment.

They paid for your rental car? They pay for your pain and suffering? Did you go to the doctor? I ride a motorcycle. I would sue him for a high dollar amount and force a better settlement.
