Legal Question in Personal Injury in California

I was involved in a car accident, the person who hit my car (police report also states the accident was her fault) did not have car insurance is there any way to make her pay for my car damages?

You can file suit in small claims court and then try to collect from the defendant.

Another option exists if you have "uninsured motorist" coverage on your own insurance policy.

If there are only damages to your car, and you have collision coverage on your car, you can make a claim under this coverage and just pay your deductible. You may also have UM collision waiver so you don't have to pay anything. If you do not have these coverages and there is less than $7,500 damage to your car, you can go to Small Claims court to make a claim.

If you were injured in the accident and have uninsured motorist coverage, this might also appy.

Hopefully you had uninsured motorist coverage under your own policy so you wont have to worry about this and let your insurance company take care of it. If you didn't have this coverage get it and next time you wont be in this situation. This time you will have to sue her.

Good luck and hope this helps.
