All Most Killed by Horse on Ranch-Who is Liable?

Almost a year ago, I was nearly kicked in the throat by a horse boarded at a local Ranch,and nearly died. I had to have emergency angioplasty & now have a metal stent in my carodid artery. My insurance did not cover much of the $100,000 hospital bills, so went to the owner of the ranch & asked him for his homeowners insurance info to file a claim w/them, but he has refused. He said the horse was not his, and he is not responsible. He also said I ''assumed risk'' by being near the horse...I know, seek legal help, but I just want my bills paid!

You may, or may not, be able to prove liability against the ranch or horse owner. You won't know until you try. Not every injury is somebody else's fault. Consult with experienced personal injury counsel on all the facts and background in order to decide what can be done, including a claim against your own insurance. You could retain a personal injury attorney to sue the ranch owner (and maybe the owner of the horse); and the insurance company would defend the lawsuit, and down the road who knows, they might settle or pay a judgment you received. But if I were on the jury I would vote against you for being foolish enough to walk behind a horse. The court decision you get would depend on a number of factors including whether the courthouse (and the membership of the jury pool) is in the city or the country, your previous experience, if any, with horses, the previous behavior of the horse and the rancher's knowledge of any previous equine misbehavior.
