Legal Question in Personal Injury in California

Who's Liable?

Attacked while waiting for vehicle to be repaired - by the mechanic! He was charged with att murder, sentenced to I think, 10+ yrs. He was a partner or employee of this 'shop' where this happened, but its been discovered the shop is also his home and is listed with the county as residential dwelling, not a business. Don't believe he is the owner of the home. Are the property owners liable for civil damages as well as the attacker, and if so, are they all co defendants or is the suit filed against the owners seperate from the offender's? Also, do any lawyers take cases such as this on based on a contingent fee ?

Yes, lawyers will take viable cases like yours on a contingency basis. But, liability if any of the owner of the property is very fact dependent. The owner must have had actual or constructive notice of the danger and failed to take reasonable action. Otherwise the case is one solely agaisnt the shop and the perpertrator.
