Legal Question in Personal Injury in California

Mold in the house made me sick

There's mold everywhere under the floor, in the walls, and on the walls. I've

become sick from it. I am trying to have the landlord repair it but no result.

City inspectors have sent letters to him but nothing yet. I have to wait for

almost another month. Meanwhile I haven't been able to stay there because I

start coughing non-stop, get dizzy, and break out in rashes.

Sounds like you should find another place to live, and then, if you want, try to have the landlord pay you for moving expenses and your doctor bills.

Your health is first and foremost here. You have standing for constructive eviction based on the landlord's failure to provide you with inhabitable premises under the circumstances. However, in order for you to legally vacate the premises and/or sue for relocation damages, etc..you must do this according to the law, or you may end up being liable for damages. Re: Mold in the house made me sick

If you doctor is willing to testify that mold contamination has made you sick, that provides the basis for a legal action against the landlord, so long as he has had notice of the problem and done nothing to correct. You will want an inspection company to come take mold samples to prove its existance and nature. You will want the samples analyzed to show it is the cause of your symptoms. You can move and claim constructive eviction if he tries to sue for rent. Contact me if interested in legal help.
