Legal Question in Personal Injury in California

Personal Injury

I had dislocated my knee in August 2006 and as a result, I am having difficulties walking. My knees aren't aligned with each other. I was at a skating rink. I didn't fall over anyone. What is the statute of limitations for CA and do I have a possible case?

Without knowing more, my best guess is you assumed those risks which are incidental to the sport of skating which include the risk of falling down and dislocating your knee. This is a huge hurdle, and you haven't said anything to indicate the accident was anybody's fault other than your own. That said, the statute of limitations against is normally two years, shorter in the case of public entities, there are exceptions, and any claims should be pursued right away.

First, you haven't told us how you were hurt. You might want to repost the question with more facts so someone can give you a more concise answer.

Second, the doctrine of assumption of the risk probably applies. When you participate in an activity such as skating, you assume a certain amount of risk. This may fall within that, but we don't know.

Third, there may have been a waiver signed. Check the back of your ticket.
