Legal Question in Personal Injury in California

Personal Injury - hit with a baseball bat

Last night I was at a fraternity party. I live in the fraternity house which is an apartment complex and occupy my own apartment. Another guy in the fraternity ended up punching a girl in the face. Then he got into an argument with another guy about this. I was an innocent bystander. The guy who punched the girl called his dad who showed up with his other 50 year old friend. His friend brought a baseball bat. I went on the balcony and told them to leave because he had no business bringing the bat. He then started yelling at me and then hit me in the face with the bat. The injury isn't permanent, but my eye has scrapes and was bruised. I did file a police report and there is a warrant for his arrest. The police also took pictures. Do I have grounds for a civil suit against the man who hit me with the bat and possibly the dad who came as well?

Re: Personal Injury - hit with a baseball bat

You certainly do as to the man who hit you. Whether you have a claim against the other man will depend upon the facts.

Keep in mind that this is not likely to be a huge case given that your injuries were minor.
