I was rear ended

I was rear ended in my vehicle. I was injured. I did not have insurance but the person who rear ended me does. i got settlement to fix my car. can I still sue for medical even though I did not have car insurance at the time of the accident?

You will only be able to recover your economic damages. In other words, you can collect for wage loss and medical bills. You cannot collect any money for pain and suffering due to Prop 213. You can read more about this on my blog, www.calpiblog.com

You can get your medical and other out of pocket expenses paid, but no 'pain and suffering' damages - that is the consequence of breaking the law requiring insurance.
