Legal Question in Personal Injury in California

Who is responsible??

while at work i was driving my car around the the front of the shop. It was night and the lighting in the area wasn't the greatest. i pulled my car in and pulled over one of those concrete car stops usually found in shopping centers. A piece of rebar was sticking up approx. 4-5 inches. because of the lighting situation I did not see it. As i was leaving i put my car in reverse and started to pull away, the rebar caught ahold the the air dam under my car and ripped it off. I spoke with the manager of the property and told him what had happened. this problem has happened to at least 3 other cars i know about. Each time it has been the same concrete stop. The manager knows about the problem with the stop but hasn't fixed it. I was wondering if the owner of the sopping center is responsible for repairing my car or not.

Re: Who is responsible??

The owner is probably responsible, but it sounds like you might have known about this problem and simply forgotten when you parked. If that is the case then you are partially at fault and the owner is only responsible for a portion of the bill.
