Statute of Limitations

Could you please tell me the statute of limitations for a slip and fall aciident in California which took place at a hotel? In addition is there a separate statute of limitations for a breach of warranty action in California? Where can I find the citation for this information? Code of Civil Procedure Section 340 sets forth a one year statue of limitations in an action seeking recovery of personal/bodily injuries. There may be exceptions for a minor or very limited other situations. You should rely on the one year which is probably the one based upon your question.

The Statute of Limitations for any type of personal injury accident is one year from the date of the accident. As far as the Breach of Warranty it depends on when the warranty was issued, the length of the warranty, when the warranty was breached and how the warranty was breached.
