Legal Question in Real Estate Law in California

30 notice

my lease is expires 12/01/01 I notified the landlord on 11/09/01 in person and in writing that I would not be renew my lease and that I would be vacating the premises as of 12/01/01. Am I still obligated to pay a prorated amount upto the 9th of Dec. to comply with a 30 day notice?

Re: 30 notice

If you have a true lease agreement, as opposed to a month-to-month rental, the lease terminates on the date specified in the lease.

There could be other terms in the lease that requires otherwise, which I would need to read to respond.

Re: 30 notice

If your lease had a fixed term, i.e., one year, no notice by either landlord or tenant is necessary in order to terminate it at the end of that term, although giving notice of intention not to seek a renewal, etc. is customary and appropriate. If, however, this was a month-to-month lease, 30 days' notice is necessary to effect a termination. The notice can be given on any day of the month, and the lease terminates 30 days thereafter.
