Legal Question in Real Estate Law in California

Looking for an attorney to look over an agreement letter

I am buying a house with my boyfriend. The mortage is in his name, but we are going to pay all the expenses 50/50. Our accountant has prepared an agreement letter between us that outlines the fact that we are equal partners in this purchase. I would like somebody to look over the letter and make sure it is prepared in good form and that it will protect my rights.

Your zip code suggest you're in Napa. I practice law in Santa Rosa, and have substantial experience in this area, both preparing agreements and in handling litigation for those who didn't do agreements beforehand or where the agreements were incomplete or breached. If you would prefer dealing with someone face-to-face rather than by FAX, contact me for a free initial appointment. (707) 523-4497.

Re: Looking for an attorney to look over an agreement letter

If your accountant prepared such an agreement for you, he is practicing law without a license. That's like asking your hair dresser to sell you an insurance policy, or your auto mechanic to trade your stock portfolio.

There are other things you need to protect you besides a written agreement. For example, if the house is just in his name, there is nothing stopping him from mortgaging the house, or from one of his creditors putting a lien on it, thereby eliminating your equity.

What you really need is a co-ownership agreement. I routinely prepare them, and they spell out all of the terms of the co-ownership, and can be recorded with the county to protect your interests, even if both names are not on title.

Please call me, and I will help you out.
