Legal Question in Real Estate Law in California

Mother changing property to son & spouse after father has passed

How does my mother transfer her property over to my husband and myself after my father has passed? My mother no longer wants the property in her name.

Are we liable for anything after the property is placed in our names?

She will continue living with us but is not able to maintain the property due to she only receives disability SSI and my father in law was not eligiable for regular SSI because he was on disability SSI for so long.

If I understand your question, it appears that your mother wants to remain in the home. If that is the case, it may be wise for your mother to create a living trust. Your mother should sit down with an attorney as soon as possible so that he or she can better understand your mother's wishes and desires and help her execute them.

not that i don't trust you but i would arrange an appointment with an attorney expertise in estate planning so she can personally without you keep the appointment and tell him/her her desires and her his/her advice and allow that attorney prepare the documents accourding to her wishes --- you didn't say if you were the natural chiid of this women and/or if you have any siblings -- if you do it all yourself and you are not the natural child and have siblings, 1/2, step or otherwise be prepared for a major fight and then you will be contating me because i'm the best attorney to defend you after over 30 years of practice in that business
