Legal Question in Real Estate Law in California

Rent obligation

Hello,

Recently I relocated to a new city and moved into a two bedroom apartment with another person who advertised on craigslist. I paid weekly at first and then signed an agreement to pay monthly starting next month. The roomate turns out to be questionable as he goes through my stuff, and leaves me wondering about the security of my mail and personal information. I really need to get out asap and am looking for some advice because I already signed the contract. Thanks,

Evan

Re: Rent obligation

Well, the important thing here is not so much how often you pay (although that is of some significance, see below), but what the paper you signed says about the duration of the hiring. Does it refer in any way to month-to-month? Notice requirements?

If the agreement is silent on the duration of the hiring, it would be deemed a month-to-month rental because the rent is paid monthly. You would need to give 30 days' notice. The notice doesn't have to be given on the anniversary day of the month, however; you can start the 30-day period any day.

Since you are now aware that the roommate snoops and might steal, take the necessary steps to remove either the temptation or the harm by keeping your most valuable stuff alsewhere, like in your car or at work, and consider having your mail forwarded to a P.O. box.
