Legal Question in Sexual Harassment in California

retaliation for filing a sexual harassment claim. legal?

filed a sexual harassment claim against a manager of the company i work for.the G M has retaliated agains me mention several times that he is going to give me a warning. he is been intimidateting me for days.

what can i do ?

you can have the attorney you retained or planning to retain put this person on notice that his conduct may be an illegal violation of "whistleblowing laws" and that he should cease and desist further "retaliation" against you for lawfully reporting the incident, based on the facts you have given so far. if you would like further assistance in this matter, email my office with more details today.

If you have evidence to prove theharassment, and the retaliation, then you have a legal claim against the company. If they fire you, it becomes wrongful termination. Contact me to discuss the facts if you are interested in pursuing your claim.

Unfortunately there is nothing you can do at this point except document the harassment. Once it comes time for the EEOC or Department of Fair Employment and Housing (DFEH) to investigate or you file a lawsuit then you will be able to take affirmative steps.

You just need to hang in there, document everything, and keep records so that you lawsuit will be easier to prove. If you haven't done so, file a claim with DFEH. If this is a sexual harassment claim you want to sue under State law and not federal law. This is very important. You have much broader rights under State law.
