Survivors benefits

My aunt and uncle were together for 27yrs, but only got married one before he died of cancer.survivors benefits were denied because a marriage is considered valid after 9 months.But there is a section in the ssa website that says the 9 month time limit is not valid if the person had a terminal illness.Next month shes going to an appeals court, what can she do or say to help?

does she currently have attorney representation for her court appearance? if so, the legal citation you included in your email would be a good starting point for her and/or her attorney. if you can let me know a little more about what is being appealed precisely and if your aunt has legal representation already or not,i may be able to further assist you in this appeals process.
