Benig charge a Civil Assesmnet fee for ticket I never received????

2 years ago I was in a traffic collision where the police said that I would ''probably'' be receiving a ticket for an unsafe lane change. A few days later I received a ''warning'' in the mail but didn't describe what. I called the police dept. and asked what to do, I was told not to worry that I would ''probably'' receive a ticket in the mail. No ticket ever arrived in the mail for the last 2 years. I just recently found out that a ticket was issued, and I was charged a civil assesment fee for not showing up in court. I don't mind paying the ticket, but is there some way to fight the $250 civil assesment fee?

Thanks for your posting.

You are required to have notice of a court date, and typically that is done by a ticket. In this case, depending on what the warning in the mail stated, you may be considered to be notice, even if you did not get a ticket sent to you in the mail as promised.

If I might recommend something, you should look at the notice, and if it did not have a time and date, you should bring that up to a judge, and you may get the charge dismissed. An attorney can help you with this.
