Legal Question in Traffic Law in California

Ask judge to dismiss charges

I was in an accident where I wrecked a motorcycle at about 65 mph. No other vehicles or property involved (except 1 small ''no parking'' sign on single pole). I suffered 10 broken ribs, lacerated spleen, kidney, pancreus, and spent a week in intensive care. I'm now home and recovering (scheduled to take 3 months...) I was cited for driving on suspended license and want to ask the judge to dismiss charges as the injuries I suffered, I believe are punishment enough. Is this a reasonable request and if so, how should I present it to the court? thank you

Re: Ask judge to dismiss charges

It's up to the prosecutor, not the judge, to dismiss the charges.

I'd recommend hiring an attorney in your area to negotiate with the prosecutor. I doubt that an unconditional dismissal will result from this, but you might receive a lenient sentence.

Good luck!
