Name change law-minors

If you have used a last name since you were a toddler-2 years (school, baptism, communion, etc..), isn't it legal automatically after so many years? My daughter hasn't seen her biological father since birth-she is now 13, she has used my husband's name since, I filed a petition for a minor name change. I'm worried it will be denied. Do I have to notify her biological father? I was 16 when I had her (i'm 30 now)-I haven't seen him since. Last I heard he was in prison. What are my recourses?

it is legal for her to use any name she wants without petitioning for a name change but if she does petition the father must be notified.
