Legal Question in Wills and Trusts in California

my dad died named his bro as executor, he doesn't want the job. has been stealing already and the kids only are to recieve any benefit from the estate. i don't trust him and want to take over.

what can i do without it taking forever.?

Ordinarily to be the executor requies Court approval and the Executor would hire an attorney to represent the Executor and the attorney typically prepares the inventory and accounting. It is unclear if any of that has happened in your case. The executor may have a bond, which would protect the estate from theft, or may not have a bond. Unfortunately, if you require court action it will take time to sort out whether assets are missing and distribution of the Estate. I suggest you find a local attorney you can work with to get to the bottom of this situation.
