Legal Question in Wills and Trusts in California
My grandmother would like to begin working on a living trust; however, she was told there was lein on her house which would have to be lifted before any work could be done. She paid off the house in the 1970's and went through the Veteran's Adminstration for the loan (she does has verification from the VA the loan was paid off). She took out a second on the house and also paid that off as well; however, the company she went with never filed the papers saying the loan was paid off and has since went out of business. I contacted the Los Angeles County Hall of Records of Real Estate and they said it would be necessary to seek legal adive regarding which steps to follow next since the company no longer existed. Whoever told you that she could nt create a trust prior to removing all liens was not telling you the complete story. This can be done with liens and encumbrances on the property.
