Legal Question in Wills and Trusts in California

My Grandmother Recently passed. In the probated will her entire estate was to divided evenly amongst all her children. Each Name listed. My mother is the only deceased child of My Grandmother. What type of form to I need to file with the court, lawyer in order to claim my mothers portion of the estate for my sisters and I. My mother was listed as deceased. I can see how the court missed that or failed to addressed if there are any heirs to claim on the behalf of the decendents predeaced chld as it is listed on the petition as an option. Need to file with the court. Not sure why my aunt who is the executor did not list our names and addresses under my mothers name.

You need to speak to the administrator of the estate and then perhaps another attorney who handles probates. The actual language of the Will may provide that the assets go only to the living children of your grandmother and not to the children of a deceased child.
