Legal Question in Wills and Trusts in California

My sister passed away in AUGUST 2009.How can I find out if she has a will? We have different moms and her mom claims that my sister died withoot a will. My sister died after a long battle with cancer so when she was ill I never asked her if she had a will.

You wouldn't know for sure unless you saw the will. If no probate is opened, there is no way to verify that she had a will, unless someone comes forward, such as a family member, or the attorney who prepared the will. You would have to search with the courts to determine whether a probate case was filed.
