Re: Assault/Battery Worker's Comp Questions

If you were injured on the job, you do have a workers comp claim. You need to report the injury to your employer right away. You would also have a 3rd party civil claim against the person who assaulted and battered you. This is also known as a workers comp., 3rd party claim. I would not try to deal with this case without an attorney because in almost all cases like this, you will get screwed on your own.

I can handle the entire case for you. You said to give you a call, however, your number was not posted. Why dont you give me a call anytime at 818-427-6246 which is my personal cell phone. If I do not answer, leave a detailed message and I will call you back.

Re: Assault/Battery Worker's Comp Questions

from the facts given, you would have not only a worker's compensation claim for your injuries against your employer under a vicarious liabililty theory known as respondeat superior, but you would also have a claim against the person who actually assaulted and battered you civilly and/or criminally. if you would like further assistance in this legal matter, feel free to email me directly with more facts and how you would like to proceed.
