Legal Question in Workers Comp in California

-=* My non-workers/comp benefits are being billed to me... shouldn't they pay it

I've been on Workers Compensation for a year and 3 months now after sustaining a back injury that required surgery with metal hardware and fusion.

My question has to do with my company. They are now billing me for my normal (non-workers/comp.) benefits (medical/dental). I'm already struggling with bills since workers compensation dosn't pay much but now an extra bill for $210.00 a month is being handed to me. Am I liable for paying this? Shouldn't my employer or Workers comp. insurance pay for this? It's unfair that now I will be forced to lose my medical and dental benefits because I simply cannot afford it due to this injury. Geesh, haven't I had enough pain??????????

Sincerely,

Frustrated & stressed

Thank you for your time and information.

The system is very adversiarial and the insurance companies do anything they can to reduce the amount of payments to the injured worker. Fortunately you have four years to file an application for adjudication. However, do not delay in obtaining representation. Attorney's fees are strictly fixed a 9% to 12 % of settlement or award. Notice to the employer and the carrier must be made immediately if not done before. You are entitled to temporary disability pay, medical treatment, permanent disability pay and vocational rehabilitation benefits. Call me directly at (619) 222-3504.
