Legal Question in Workers Comp in California

returning to work

I am currently receiveing Temp. dis and treatment for a broken leg that occurred at work. I am likely to be released in 3 weeks with a probable P&S report. I do not want to go back to work for the same company which is a very phisically demending location and position and have accepted other employment that will commence once I am released in 3 weeks. It is a similiar though less physically demanding job. What is my obligation to my employer and is there a risk in 'giving notice' while on temp. disability? Also I have been consulting, not physicallly working, without any compensation for the new company am I in any violation ? Thank You

you have no obligation to return to the same employer. In fact in most cases the employers do not even offer many injured workers their jobs.

Do not give notice and wait and see what the doctor says he may say you can't do the work. Wait for the report and then you can decide.
