Legal Question in Workers Comp in California

settlement offers

I believe that if injured in an auto accident and fault is admittedly not yours you can pretty much request 3x's your medical expenses and get it. is there any rules like that for workers compansation? I have an offer now based on all their rules but don't know really what entitled to. my case began 10-17-2001.

Re: settlement offers

First, plaintiff's rarely receives 3x the medicals in personal injury although this used to be the tradition many years ago.

As far as your workers compensation claim goes, it will be settled according to your level of permanent disability as well as your future medical. However, I would recommend that you contact my office immediately prior to settling your case in order to make sure that your settlement is fair. Since you are not represented by an attorney, it is more likely than not that your employer is depriving you from what you are legally entitled to.

Good luck.
