Legal Question in Workers Comp in California

I have received a 10%whole person impairment rate via AMA guides.Rated range of motion method:2 level prodisc replacement L4-5,L5-s1,w pain/rigidity wS1nerve root sensory deficit=grade 4-25% sensory deficitX5% maximum lower extremity impairment of the S1 nerve root =1%lower extremity impairment converted to a 10% whole person impairment. I continue to have L LE pain w weakness as well as moderate amt of neuropathy. I continue to require percocet for pain on a daily basis, can sit or walk short periods of time only. I have been offered by the Ins carrier $ 20,000.00 to settle. I find this to be quite low since I cannot return to my job as an RN and will have to start at an entry level job , at age 53 !I do not have an attorney. Please tell me what you think my situation is worth.Thank you

I think an attorney might be of benefit. You should definitely speak with the I&A office. You did not provide a date of injury. However, if the date of injury is pre 1/1/05 ther are several factors which are used to determine whether the case falls under the new or old system. Note, it is not the date of injury that controls, but the medical reporting.

Unfortunately, if you fall into the new AMA guidelines, there is not a signifanct amount of disability for you. The legislature has mandated such.
