Legal Question in Workers Comp in California

i had surgery on my hand and work comp ok it. and now are saying they made a miss and there not paying the surgery center , they paided everything but surgery center and my attorney is not doing anything about it...what can i do..i have paper work saying i can have surgery and had it.. and now they say Oop's...

If they stated that you could have surgery and they would pay for it and on that basis you went and had the surgery, believing it to be work related, then they are estopped from arguing about payment of the billing if it is reasonable in amount. Also, I doubt the surgery would show anything to make them believe the injury was non-industrial [it is possible it could in some few cases], so it may have been negligence in how they investigated your case that caused the delay in rejecting your claim. Your attorney may feel that going to a hearing as to a delay in paying medical bills may not be worthwhile yet; find out what his reasoning is.
