Legal Question in Workers Comp in California

Time Frame

I've been on Worker Comp for over a year in a half and the doctors told me I have nerve damage between the third and fourth toe and Rheumatoid arthritis And now the company 's attorney wants me to see their doctors I've seen 2 doctors through workers comp and one through my lawyer and now I need to see other one they all say the same thing

I just want to know will they give me life time medical and for pain and suffering or what?

And how much longer will this all take?

Re: Time Frame

Difficult to say how long this takes. However, you can only receive temporary disability for up to 2 years and that is quickly approaching. Since your injury occurred after Jan 1, 2005 they cannot just send you to their own doctors. There is something called a Panel Qualified Medical Examiner which they may send you to. If you have an attorney, you need to ask them about that. I don't have all of the details, but the employer must follow a process. If you do not have an attorney you need to talk to one or hire one. Under the Labor Code attorneys who practice workers' compensation cannot charge a fee until the case is resolved, so it cost you nothing right now to get an attorney. NO attorney should ever charge you a consutation fee. Most workers' compensation attorneys will not charge for any costs either. If you would like to discuss this further, feel free to contact me.
