Legal Question in Workers Comp in California

workman comp case

I received the first offer to settle my case in December, 2008. Since then, my attorney felt we could ask for more. Since then, I have only been working a parttime job because that all I can find in CA. So, I have called my attorney almost every week to accept the first offer and close the case. His office keeps putting me off and the office states, the defendant keeps putting him off. I want to settle now. Do we have to wait for the defendant to respond back since I'm in agreement with the first offer? Can't we just go before the court and close?
