Legal Question in Real Estate Law in Canada

Legal changes to Strata bylaws

I remember in British Columbia that some strata properties tried to ban activities on common areas (street hockey). They challenged the changes and I believe they won. I am looking to use this as references for my complex.

Thank you

Re: Legal changes to Strata bylaws

I can not locate the a report of a final decision on street hockey and the strata corporation although I know of one case that was commenced in BC. I do not see any reason why a strata council cannot control an activity such as street hockey on common property of the strata corporation so long as the strata corporation can justify the bylaw as being "for the benefit of the owners" and not "unduly prejudicial" to any one or group of owners.
